Can I buy a plan in the Marketplace if I don’t have a green card?

Potentially, yes. You must have a qualifying immigration status, such as permanent residency (green card), certain types of visas, refugee status, or, starting in November 2024, Deferred Action for Childhood Arrivals (DACA). You can find more information about qualifying statuses here.

You can also shop for health insurance outside of the Marketplace in the individual market and some states may offer you financial assistance, depending on your income. Many insurers offer policies outside of the Marketplace with the same consumer protections and covered benefits as those sold on the Marketplace. “ACA-compliant” plans outside of the Marketplace are prohibited from turning you down based on your health status or your immigration status and must follow generally the same rules as plans in the Marketplace. To obtain coverage, contact a state-licensed health insurance company or a licensed agent or broker. Your state department of insurance can help you find one.

Non-ACA-compliant plans are also available off the Marketplace, including short-term health plans, but they can exclude people with pre-existing conditions and offer more limited benefits. If you are shopping outside of the Marketplace and you want an ACA-compliant plan, be sure to specify that to the insurer or broker you’re working with.
